Non-profit status

The term charitable status (Gemeinnützigkeit) describes the pursuit of a purpose that serves the common good. Organizations active in charitable work advocate for areas such as education, the environment, health, culture, religion, international understanding, or social justice – without the intention of making a profit. The legal basis is Section 52 of the German Fiscal Code (Abgabenordnung - AO). Only organizations recognized as charitable are permitted to issue donation receipts and enjoy tax benefits.

Who can have charitable status?

Charitable status can be obtained by various legal forms – including registered associations (e. V.), foundations, non-profit limited liability companies (gGmbHs), and even corporations with a clearly defined charitable purpose - for example, non-profit stock corporations (gAGs).

How do you obtain charitable status?

Recognition is granted by the responsible tax office on the basis of the organization's articles of association and actual management. The purpose must be clearly formulated and directed towards charitable activities. The tax office confirms the charitable status with the notice of exemption (Freistellungsbescheid).

Can charitable status be recognized retroactively?

Yes, under certain conditions, status can be granted retroactively – for example, for newly founded organizations if they have conducted their activities as charitable from the very beginning.

Example:

An organization that establishes educational projects in structurally weak regions can be recognized as charitable. Its income must be used exclusively for this purpose. Donors receive donation certificates and can claim their contributions for tax purposes.
